Online Duty Free Terms and Conditions

Article 1. (Purpose)

The purpose of this Agreement is to protect the rights, obligations, and responsibilities of users of Hyundai Department Store Internet Duty Free in using the services provided by Hyundai Department Store Duty Free Online Shopping Mall (hereinafter referred to as "Hyundai Department Store Internet Duty Free Shop") operated by Hyundai Department Store.

Article 2. (Definition)

The terms used in these terms and conditions are defined as follows.

     The term "Hyundai Department Store Internet Duty Free Shop" means a virtual business place established by a company to trade goods or services by using information and communication facilities such as computers to provide goods or services to users, and shall also be used as a meaning of a company operating a Hyundai Department Store Internet Duty Free Shop.

     The term "Hyundai Department Store downtown duty-free shop" means an offline business place operated by a company to provide goods or services to users.

     The term "user" means a member or non-member who accesses the "Hyundai Department Store Internet Duty Free" and receives services provided by the "Hyundai Department Store Internet Duty Free" under these terms and conditions.

     The term "member" means a person who has registered as a member by providing personal information to the "Hyundai Department Store Internet Duty Free Shop," and "a person who can continue to use the services provided under these terms and conditions."

     The term "non-member" means a person who does not subscribe to a member and uses services provided by the "Hyundai Department Store Internet Duty Free Shop."

 

Article 3. (Specification and revision of terms and conditions )

     The "Hyundai Department Store Internet Duty Free Shop" shall post the contents of these terms and conditions, the name of the trade name and representative, the address of the business office (including the address of the place where consumer complaints can be handled), telephone number, e-mail address, business registration number, mail order registration number, mail order report number, personal information management manager, etc. on the initial service screen (front) of the "Hyundai Department Store Internet Duty Free Shop" so that users can easily see the contents of the terms and conditions through the connection screen.

     The "Hyundai Department Store Internet Duty Free Shop" may amend these terms and conditions to the extent that it does not violate relevant laws such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Electronic Transactions, the Electronic Signature Act, the Electronic Financial Transactions Act, the Act on Promotion of Information and Communication Network Utilization and Information Protection, and the Consumer Protection Act.

     Where the "Hyundai Department Store Internet Duty Free Shop" revises these terms and conditions, it shall be notified in the same manner as in paragraph (1) from seven days before the date of application to the day before the date of application, along with the current terms and conditions, by stating the date of application and the reason for the amendment. Provided, That where the details of the terms and conditions are changed unfavorably to the user, the notice shall be made with a grace period of at least 30 days in advance. In such cases, the "Hyundai Department Store Internet Duty Free" shall clearly compare the contents before the amendment with the contents after the amendment and display them in an easy-to-understand manner.

     If the "Hyundai Department Store Internet Duty Free Shop" revises the terms and conditions, the revised terms and conditions will apply only to contracts concluded after the date of application, and the terms and conditions before the amendment will apply to contracts already concluded before that date. However, if a person who has already signed a contract wants to be subject to the terms and conditions of the revised terms and conditions by sending them to the "Hyundai Department Store Internet Duty Free Shop" within the notice period of the revised terms and conditions under paragraph (3) and obtaining the consent of the "Hyundai Department Store Internet Duty Free Shop," the revised terms and conditions may be applied.

     Members may request to withdraw from the revised terms and conditions if they do not agree to the revised terms and conditions, and if they do not express "disagree" to the revised terms and conditions posted on the "Hyundai Department Store Internet Duty Free" service screen, they will be considered to agree to the revised terms and conditions.

     Matters not prescribed in these Terms and Conditions and interpretations of these Terms and Conditions shall be in accordance with the Consumer Protection Act in Electronic Commerce, the Regulation of Terms and Conditions, the Consumer Protection Guidelines in Electronic Commerce, etc. prescribed by the Fair Trade Commission, and related laws or regulations.

 

Article 4. (Provision and alteration of services )

"Hyundai Department Store Internet Duty Free Shop" performs the following tasks.

1. Provision of information on goods or services and conclusion of a purchase contract

2. Delivery of goods or services contracted for purchase

3. Other duties prescribed by "Hyundai Department Store Internet Duty Free Shop"

The "Hyundai Department Store Internet Duty Free Shop" may change the contents of the goods or services to be provided by a contract to be concluded in the future, in the event of out-of-stock goods or services or changes in technical specifications, etc. In such cases, the details of the changed goods or services and the date of provision shall be specified and immediately notified to the place where the current goods or services are posted.

If the contents of the service contracted with the user to be provided by the "Hyundai Department Store Internet Duty Free Shop" are changed for reasons such as out of stock or a change in technical specifications, the reason shall be immediately notified to the user by means of notification (e-mail, SMS, etc.).

In the case of the preceding paragraph, the "Hyundai Department Store Internet Duty Free Shop" shall compensate for damages incurred by users: Provided, That this shall not apply where the "Hyundai Department Store Internet Duty Free Shop" proves that it is not intentional or negligent.

 

Article 5. (Service Disruption)

Hyundai Department Store Internet Duty Free may temporarily suspend the provision of services in the event of maintenance, inspection, replacement, or failure of information and communication facilities such as computers or computer networks.

The "Hyundai Department Store Internet Duty Free Shop" shall compensate a user or a third party for damages caused by the temporary suspension of the service due to the reasons referred to in paragraph (1). Provided, That this shall not apply where the "Hyundai Department Store Internet Duty Free Shop" proves that it is not intentional or negligent.

Where it is impossible to provide services due to the conversion of business items, abandonment of business, integration among companies, etc., the "Hyundai Department Store Internet Duty Free Shop" shall notify users in the manner prescribed in Article 9 and compensate consumers according to the conditions prescribed in advance by the "Hyundai Department Store Internet Duty Free Shop." Provided, That where the "Hyundai Department Store Internet Duty Free Shop" fails to notify the standards for compensation, etc., users' mileage, reserves, etc. shall be paid to users in kind or in cash equivalent to the currency value used in the "Hyundai Department Store Internet Duty Free Shop."

 

Article 6. (Join the membership)

Users apply for membership by selecting one of the following membership types, filling in their membership information according to the designated subscription form, and expressing their consent to these terms and conditions.

1.      Integrated H.Point membership operated by Hyundai Department Store Group and a customer who has joined the "Hyundai Department Store Internet Duty Free Shop" (Korean Mall only) at the same time as a member of the H.Point membership, "Hyundai Department Store Internet Duty Free Shop" and "Hyundai Department Store City Duty Free Shop."

2.      H.Point Transition Membership: Membership of H.Point operated by the existing Hyundai Department Store Group and who have newly joined the "Hyundai Department Store Internet Duty Free Shop" (Korean Mall) and converted into an integrated member. Membership of H.Point, "Hyundai Department Store Internet Duty Free Shop" and "Hyundai Department Store City Duty Free Shop" are available

3.      Convenient Duty-Free Shop Members: Members of the "Hyundai Department Store Internet Duty Free Shop" who can use the services of "Hyundai Department Store Internet Duty Free Shop" and "Hyundai Department Store City Duty Free Shop."

The "Hyundai Department Store Internet Duty Free Shop" shall be registered as a member unless it falls under any of the following paragraphs among users who have applied to join as a member as in paragraph (1).

1.      Where an applicant has previously lost his/her membership pursuant to Article 7 (3) of these Terms and Conditions (However, if three years have passed since the loss of membership, he/she may re-register with the consent of the "Hyundai Department Store Internet Duty Free Shop")

2.      Where there is a false, omission, or misspelling in the contents entered or provided by the user for registration

3.      Where it is deemed that registration as a member is significantly hindered by the technical or performance of duties of the "Hyundai Department Store Internet Duty Free Shop."

4.      Under the age of 14

The time when the membership contract is established is when the approval of the "Hyundai Department Store Internet Duty Free" reaches the member.

If there is any change in the registration, the member shall immediately notify the "Hyundai Department Store Internet Duty Free Shop" by e-mail, entering the member information modification menu on the website, and other means.

5 All user information on the membership application form is considered true and actual data. If you do not enter your real name or actual information, the user may not be legally protected and may be restricted from using the service.

 

Article 7. (Membership withdrawal and loss of eligibility)

A member may request withdrawal from the "Hyundai Department Store Internet Duty Free Shop" at any time, and the "Hyundai Department Store Internet Duty Free Shop" shall handle withdrawal of members immediately. Provided, That if there is a product purchased at the time of requesting withdrawal but has not been delivered, the deposit and gift certificate conversion money shall be held after the delivery of the product is completed, and if there is any in-progress consultation details, the necessary measures shall be taken to withdraw from the membership after the processing is completed.

If a member who joined the Hyundai Department Store Internet Duty Free after joining the "Hyundai Department Store" withdraws from the "Hyundai Department Store Internet Duty Free" membership, he/she will also withdraw from the "Hyundai Department Store City Duty Free" membership.

3 If a member falls under any of the following reasons, the "Hyundai Department Store Internet Duty Free Shop" may restrict or suspend his/her membership.

1. Where false information is registered at the time of application for subscription or when using services such as purchasing products

2. Where it interferes with the operation of the "Hyundai Department Store Internet Duty Free Shop" by falsely changing the information provided to the "Hyundai Department Store Internet Duty Free Shop."

3. Where membership is registered or used by fraudulent means, such as the use of macro programs, theft of names, and infringement of information and communications networks

4. Where the member fails to pay on the due date for the payment of goods, etc. purchased using the "Hyundai Department Store Internet Duty Free Shop" and other debts borne by the member on the "Hyundai Department Store Internet Duty Free Shop."

5. In the case of threatening the e-commerce order, such as interfering with the use of other people's "Hyundai Department Store Internet Duty Free Shop" or stealing information

6. Where the membership service of "Hyundai Department Store Internet Duty Free" is used by fraudulent methods or purposes

7. In the case of repeatedly canceling, returning, etc. after use or requesting compensation even though there is no defect in the purchased product or service

8. Where it is deemed that the "Hyundai Department Store Duty Free Shop" is damaged or is likely to cause damage by repeatedly canceling an order before receiving a product

9. In the case of defaming another person for nothing on the online screen of the "Hyundai Department Store Internet Duty Free Shop."

10. Where false facts are publicly indicated or disseminated in connection with the operation of the "Hyundai Department Store Internet Duty Free Shop."

11. Where insults, threats, verbal abuse, assault, obscene words, etc. are made to employees of the "Hyundai Department Store Duty Free Shop" in the process of using the "Hyundai Department Store Duty Free Shop."

12. Where an act prohibited by Acts and subordinate statutes or Article 20 of these Terms and Conditions and other acts prohibited by these Terms and Conditions by using the "Hyundai Department Store Internet Duty Free Shop" or acts contrary to public order and morals

13. Where there is a reasonable reason to restrict or suspend membership, such as in cases of deliberately interfering with the operation of other services

4 Hyundai Department Store Internet Duty Free has restricted or suspended its membership, but if the member does the same or the reason for the violation is not corrected within 30 days, the member may lose his/her membership.

5If the "Hyundai Department Store Internet Duty Free" loses its membership, the membership registration will be canceled. In this case, the members will be notified and given an opportunity to explain for a certain period of time before the membership is canceled.

6In accordance with Paragraph 4 of this Article, members whose membership registration has been canceled will be restricted from rejoining.

 

Article 8. (Services provided and withdrawal of integrated members)

The following services are provided to H.Point integrated members and duty-free convenience members.

1. Discounts: You can get benefits such as "Hyundai Department Store Internet Duty Free" and "Hyundai Department Store City Duty Free" and discounts and free gifts offered by its affiliates.

2. Preferential benefits: Members can accumulate purchases at Hyundai Department Store Internet Duty Free Shop and Hyundai Department Store City Duty Free Shop, and receive preferential benefits or services according to the membership policy set by Hyundai Department Store Internet Duty Free Shop.

3. Other Services: "Hyundai Department Store Internet Duty Free" may develop and provide additional services and benefits to its members for their benefit.

Non-members will not be eligible for the "Hyundai Department Store Internet Duty Free" membership, and members who do not collect passport number information among members will also be restricted from providing the "Hyundai Department Store Internet Duty Free" membership service.

In the event of withdrawal or disqualification from H.Point integration, the same shall apply to Hyundai Department Store Internet Duty Free, and the detailed procedures shall be in accordance with Article 7 of these Terms and Conditions (withdrawal and disqualification).

However, if a customer who has transitioned to an integrated H.Point member after signing up for a duty-free shop convenience member leaves the H.Point service or loses eligibility, the duty-free shop convenience member status will remain the same.

 

Article 9. (Notice to a member)

If the "Hyundai Department Store Internet Duty Free Shop" notifies members, they can use the electronic mail address or mobile terminal designated by the member in advance agreement with the "Hyundai Department Store Internet Duty Free Shop."

      The "Hyundai Department Store Internet Duty Free Shop" may substitute for individual notices by posting notices to a large number of unspecified members on the bulletin board of the "Hyundai Department Store Internet Duty Free" for at least seven days: Provided, That individual notices shall be given to matters that have a significant impact on the member's own transaction.

 

Article 10.  (Application for purchase and consent to provision of personal information, etc) 

A user of the "Hyundai Department Store Internet Duty Free Shop" shall apply for a purchase through the following or similar methods only if he/she is scheduled to leave the country, and the "Hyundai Department Store Internet Duty Free Shop" shall provide the following information in an easy-to-understand manner when applying for a purchase.

1. Search and selection of goods, etc

2. Enter recipient's name, address, phone number, e-mail address (or mobile phone number)

3. Passport number, scheduled date of departure, flight name or ship name, departure airport or ship port

4. Confirmation of the contents of the terms and conditions, the service to which the right to withdraw the subscription is restricted, delivery fees, installation costs, etc

5. Indication that you agree to these terms and that you confirm or reject the matters in subparagraph 4 above (e.g., click on the mouse)

6. Consent to the application for purchase of goods, etc. and confirmation of such goods or confirmation of "Hyundai Department Store Internet Duty Free Shop"

7. Selection of payment method

Users of the "Hyundai Department Store Internet Duty Free Shop" must enter their name, phone number, passport number, and destination (departure information such as departure date and time of departure, flight name, etc. for delivery of the delivery certificate) and express their consent to these terms and conditions and payment-related terms and conditions.

If the "Hyundai Department Store Internet Duty Free Shop" needs to provide the buyer's personal information to a third party, 1) the person who receives the personal information, 2) the purpose of using the personal information of the person who receives the personal information, 3) the items of the personal information to be provided, and 4) the period of possession and use of the personal information of the person who receives the personal information shall be notified to the buyer and consent shall be obtained. (The same shall apply to changes in matters that have been agreed upon.)

Provided, That if it is necessary to implement a contract for the provision of services and is related to the promotion of convenience of purchasers, it is not necessary to go through the notification procedure and the consent procedure by notifying them through the personal information handling policy in the manner prescribed in the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc.

 

Article 11.  (Establishment of a contract)

The "Hyundai Department Store Internet Duty Free Shop" may refuse to accept the purchase application under Article 10 if it falls under any of the following subparagraphs. On the other hand, in the case of signing a contract with a minor, the minor himself or his legal representative may cancel the contract if the legal representative does not agree to the contract.

1. If there is a false, omission, or misspelling in the application content

2. Where a minor purchases goods or services prohibited by the Juvenile Protection Act, such as cigarettes and alcohol

3. Where a "member" whose membership has been restricted or suspended under the subparagraphs of Article 7 (3) and a "non-member" whose membership has been lost pursuant to paragraph (4) apply for purchase

4. Where a "user" who violates Article 20 applies for purchase

5. Where it is deemed that the acceptance of other purchase applications is significantly hindered by the technology of "Hyundai Department Store Internet Duty Free Shop."

The order of the "user" shall take effect as an subscription for purchase from the time the payment is made, and the purchase contract shall be deemed to have been established at the time when the of the intention to accept the "Hyundai Department Store Internet Duty Free" reaches the user in the form of a notice of receipt under Article 12 (1).

If the user is found to have committed any of the following violations even after the notice of receipt reaches the user, the "Hyundai Department Store Internet Duty Free Shop" may immediately suspend the performance of the contract, such as the delivery of goods, within 10 days after the notice of receipt reaches the user and request the user to correct it within 15 days from the date of suspension, and may cancel or terminate the contract withheld if it is not corrected without a reasonable explanation within this period. If the user's violation falls under any of Article 7 (3) 3, 6 or Article 20 (2) 9 of this Agreement, the contract may be canceled or terminated without a notice.

Article 12. (Notification of receipt confirmation, change and cancelation of purchase application)

     "Hyundai Department Store Internet Duty Free" notifies users of receipt confirmation when they apply for a purchase.

     A user who has received a notice of confirmation of receipt may request to change or cancel a purchase application immediately after receiving the notice of confirmation of receipt, and the "Hyundai Department Store Internet Duty Free Shop" shall, if requested by the user before delivery, process it according to the request without delay: Provided, That if the payment has already been made, it shall be governed by the provisions of Article 16 on withdrawal of subscription, etc..

 

Article 13. (Payment)

The payment method for goods or services purchased at the "Hyundai Department Store Internet Duty Free Shop" may be as follows: Provided, That the method of operation thereof shall be determined by the company, and the "Hyundai Department Store Internet Duty Free Shop" may not collect any nominal fee in addition to the price of goods, etc. with respect to the user's payment method.

1. Cash payment such as deposit without a bankbook

2. Credit card payment

3. Gift certificates and points affiliated with "Hyundai Department Store Internet Duty Free Shop"

4. Small payment on a mobile phone

5. Reserves and Points

6. Other electronic payment methods

 

Article 14. (Supply of goods, etc.)

The "Hyundai Department Store Internet Duty Free Shop" specifies the means of delivery, delivery period, and delivery method for the goods purchased by the user.

In accordance with the Customs Act on the Sale of Duty-Free Shop Products and other relevant domestic laws and regulations, the "Hyundai Department Store Internet Duty Free Shop" transports goods purchased by users to the delivery center of the departure hall located at the airport or port where users use them when they leave the country. On the day of departure, users can present their passport and boarding pass at the delivery center of the Hyundai Department Store duty-free shop located in the departure hall and receive the goods purchased after confirming their identity. The location of the delivery center is displayed on the order information and inside each departure hall.

 If the user does not receive the goods purchased at the delivery date on the scheduled departure date, the "Hyundai Department Store Internet Duty Free Shop" stores the goods for 10 days. If the user does not receive the goods after this storage period, the "Hyundai Department Store Internet Duty Free Shop" may report the goods to customs and cancel them in accordance with the relevant laws and regulations.

 

Article 15. (Refund)

"Hyundai Department Store Internet Duty Free Shop" shall notify the user of the reason without delay if it is unable to deliver the product due to out of stock, etc. and shall refund or take necessary procedures for refund within three business days from the date of receipt of the payment in advance.

If the total amount of goods you want to exchange or refund exceeds the duty-free limit (see shopping guide on the website), you can only exchange or refund if you request an exchange or refund directly from overseas through international mail, or if you report and attract the product to customs when entering the country.

 

Article 16. (Withdrawal of subscription, etc.)

Users who have entered into a contract for the purchase of goods, etc. with “Hyundai Department Store Internet Duty Free Shop” may withdraw their subscription within 15 days from the date of receipt of the product.

After receiving the product, the user cannot return or exchange the product in any of the following cases.

1. If the goods, etc. are lost or damaged due to reasons attributable to the user (however, if the packaging, etc. is damaged in order to check the contents of the goods, etc., subscription can be canceled)

2. When the value of goods, etc. has decreased significantly due to use or partial consumption by the user.

3. When the value of goods, etc. has decreased significantly over time to the extent that resale is difficult.

4. If the packaging of the original product, etc. is damaged if it can be copied with a product with the same performance.

5. In case of violation of other return requirements and procedures in Paragraph 5 below

In the case of items 2 to 4 of Paragraph 2, if “Hyundai Department Store Internet Duty Free Shop” has not taken measures such as specifying in advance the fact that cancellation of subscription, etc. is restricted in a place where consumers can easily see, or providing trial products, etc. There are no restrictions on user cancellation of subscription.

If the total amount of the product you wish to exchange or refund exceeds the duty-free limit, send it directly from overseas by international mail, have it detained by customs (indicate duty-free exchange/refund on the invoice when sending), and then request an exchange or refund or carry it with you when entering the country. Exchanges and refunds are possible only when the product has been declared and detained at customs, and the exchanged duty-free product can be delivered at the delivery area in the departure hall when leaving the country.

Notwithstanding Paragraphs 1 and 2, in the following cases, the purchase may be canceled within 3 months from the date of receipt of the product and 30 days from the date on which the fact was known or could have been known.

1. If the delivered/delivered product is different from the order details, or is different from the content displayed or advertised by “Hyundai Department Store Internet Duty Free Shop” or the information provided.

2. If the delivered/delivered product is defective (broken, damaged, contaminated, etc.)

3. If the product is not delivered to the buyer on the departure date (in this case, there is no limit to the cancellation period)

4. If the user's subscription is made without indicating the information to be displayed in the advertisement pursuant to Article 13 of the Act on Consumer Protection in Electronic Commerce, etc.

 

Article 17. (Effect of withdrawal of subscription, etc)

Hyundai Department Store's Internet Duty Free Shop will refund the price of goods, etc. already paid within three business days when goods, etc. are returned from users.

The "Hyundai Department Store Internet Duty Free Shop" shall, in refunding the above payment, request the business operator who provided the payment method to suspend or cancel the claim without delay when the user pays the payment of goods, etc. by means of payment such as credit card or electronic money.

In the case of withdrawal of subscription, etc., the user shall bear the expenses necessary for the return of the goods, etc. supplied: Provided, That if the contents of the goods, etc. are different from the contents of the indication or advertisement or are executed differently from the contents of the contract, the "Hyundai Department Store Internet Duty Free Shop" shall bear the expenses necessary for the return of the goods, etc. Other than that, the "Hyundai Department Store Internet Duty Free Shop" shall not charge the user any penalty or compensation for damages due to withdrawal of subscription, etc.

4 If the user pays the shipping cost when receiving goods, etc., the "Hyundai Department Store Internet Duty Free Shop" clearly indicates who pays for the cost when withdrawing the subscription so that the user can easily understand it.

 

Article 18. (Personal Information Protection)

The "Hyundai Department Store Internet Duty Free Shop" collects the minimum information necessary to fulfill the purchase contract when collecting information from users.

When the "Hyundai Department Store Internet Duty Free Shop" collects the user's personal information, it must obtain the user's consent.

The "Hyundai Department Store Internet Duty Free Shop" shall not use the collected personal information for any purpose other than its intended purpose, and where a new purpose of use occurs or is provided to a third party, the relevant user shall be notified of the purpose and consent shall be obtained at the stage of use and provision: Provided, That where there is a separate provision in the relevant statutes, it shall be governed by that, and exceptions shall be made in any of the following cases.

1. Where to inform the delivery company of the minimum user's information (name, address, phone number) necessary for delivery for the purpose of delivery

2. Where a specific individual is provided in an indistinguishable form as necessary for the purpose of statistics preparation and academic research, etc

3. Where it is necessary for the settlement of the price following the transaction of goods, etc

4. Where it is necessary for identification to prevent theft

5. Where there is an inevitable reason necessary under the provisions of the Act or the Act

Where the "Hyundai Department Store Internet Duty Free Shop" requires the user's consent pursuant to paragraphs (2) and (3), the matters prescribed in the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc. shall be specified or notified in advance, such as the purpose of collecting and using personal information, the items of personal information to be collected, the period of possession and use of personal information, and the period of information provision to a third party (the recipient, the purpose of provision and the contents of the information to be provided). The user may withdraw his/her consent at any time.

Users can request permission to view and correct errors of their personal information held by Hyundai Department Store Internet Duty Free at any time, and Hyundai Department Store Internet Duty Free is obligated to take necessary measures without delay. If a user requests correction of an error, the "Hyundai Department Store Internet Duty Free" will not use the personal information until the error is corrected.

For the protection of personal information, the "Hyundai Department Store Internet Duty Free Shop" minimizes the number of people who handle the user's personal information and is responsible for the loss, theft, leakage, and tampering of the user's personal information, including credit cards and bank accounts.

"Hyundai Department Store Internet Duty Free Shop" or a third party who has received personal information therefrom shall destroy the personal information without delay when the purpose of collecting or receiving the personal information is achieved.

The "Hyundai Department Store Internet Duty Free Shop" does not collect information necessary for the performance of a purchase contract when registering as a member in advance: Provided, That this shall not apply where personal verification is required prior to the purchase contract for the performance of obligations under the relevant statutes, and where the minimum amount of specific personal information is collected.

The "Hyundai Department Store Internet Duty Free Shop" does not set the consent box for the collection and use of personal information to be selected in advance. In addition, when a user refuses to consent to the collection and use of personal information, the restricted service shall be specified in detail, and the provision of services such as membership registration shall not be restricted or rejected on the grounds that the user refuses to consent to the collection and use of personal information other than mandatory collection items.

Article 19.  (Obligations of Hyundai Department Store Internet Duty Free Shop)

The "Hyundai Department Store Internet Duty Free Shop" shall not engage in acts prohibited by law and this Agreement or contrary to public order and morals, and shall do its best to provide goods and services continuously and stably as prescribed by this Agreement.

"Hyundai Department Store Internet Duty Free Shop" maintains and manages a security system properly to protect users' personal information (including credit information) at all times so that members and other users can use the service safely.

Hyundai Department Store Internet Duty Free does not send advertising e-mails for commercial purposes that users do not want.

Service Hours and Disruption

1. The use of a service is provided by the Company open all year round, 24/7, except in special cases for business or technical reasons.

2. The Company may suspend all or part of its service offerings in the following cases. If the service is discontinued, the Company shall notify in advance or afterwards.

A) In cases where it is unavoidable due to construction, such as regular inspection and replacement maintenance of service facilities

B) When a fixed-term telecommunications business operator prescribed in the Telecommunications Business Act has stopped the telecommunications service

C) Where the use of the service is hindered due to equipment failure or congestion of use, etc

D) Where there are other force majeure reasons

 

Article 20.  (Responsibilities and obligations of users)

Members have the following responsibilities regarding ID, password, etc.

1. Members are responsible for managing their ID and password and should not allow third parties to use it.

2. If a member recognizes that his/her ID or password is stolen or used by a third party, he/she shall notify the "Hyundai Department Store Internet Duty Free" immediately and follow the guidance of the "Hyundai Department Store Internet Duty Free".

In the case of users who purchase as non-members, the responsibility for the management of personal information such as name, passport number, and phone number shall be governed by paragraphs 1 and 2.

3. If there is no reason attributable to the "Hyundai Department Store Internet Duty Free Shop" in the event of a member's ID or password leakage, we are not responsible for the transaction.

The user shall not.

1. Registration of false information at the time of application or change

2. Theft of other people's information

3. Change of information posted on "Hyundai Department Store Internet Duty Free"

4. Transmission or posting of information (computer programs, etc.) other than information prescribed by the "Hyundai Department Store Internet Duty Free Shop"

5. Infringement of intellectual property rights such as "Hyundai Department Store Internet Duty Free Shop" or third-party copyright

6. The act of advertising or conducting business without the permission of the "Hyundai Department Store Internet Duty Free Shop"

7. "Hyundai Department Store Internet Duty Free Shop" or any act that damages the reputation of a third party or interferes with the business thereof

8. Disclosure or posting of obscene or violent messages, images, voice, or other information contrary to public order and morals in the "Hyundai Department Store Internet Duty Free Shop."

9. Where the user is a minor, the act of purchasing goods prohibited by the Juvenile Protection Act, such as cigarettes or alcohol

10. Other acts that are objectively deemed illegal, unjust, or inappropriate

 

Article 21.  (Hyundai Department Store Internet Duty Free Exemption)

The "Hyundai Department Store Internet Duty Free Shop" does not have the authority to act on behalf of users who wish to purchase goods or services, and any act of the "Hyundai Department Store Internet Duty Free Shop" is not considered an act on behalf of users.

"Hyundai Department Store Internet Duty Free" is exempt from responsibility for providing services if it is unable to provide services due to natural disasters or equivalent force majeure.

 

Article 22.  (Relationship between the connect "Hyundai Department Store Internet Duty Free" and the connected "Hyundai Department Store Internet Duty Free")

     When the upper "Hyundai Department Store Internet Duty Free" and the lower "Hyundai Department Store Internet Duty Free" are connected by hyperlink, the former is called the connect "Hyundai Department Store Internet Duty Free" and the latter is called the connected "Hyundai Department Store Internet Duty Free."

     If the connect "Hyundai Department Store Internet Duty Free" indicates that it is not liable for guarantee on transactions made with users by goods, etc. provided independently by the connected "Hyundai Department Store Internet Duty Free" or on a pop-up screen at the time of connection, it shall not be liable for guarantee on such transactions.

 

Article 23.  (Copyright attribution and use restrictions) 

     Copyright and other intellectual property rights for all works (including, but not limited to, advertisements, photos, images, and text) created by "Hyundai Department Store Internet Duty Free" belong to "Hyundai Department Store Internet Duty Free".

     A user shall not reproduce, transmit, publish, distribute, broadcast, or let a third party use the information attributable to the "Hyundai Department Store Internet Duty Free" from the information obtained by using the "Hyundai Department Store Internet Duty Free" for profit without prior consent from the "Hyundai Department Store Internet Duty Free".

     The "Hyundai Department Store Internet Duty Free Shop" shall notify the user of the copyright attributable to the user under the agreement.

 

Article 24.  (Dispute Resolution)

     The "Hyundai Department Store Internet Duty Free Shop" establishes and operates a damage compensation organization (customer center) to reflect legitimate opinions or complaints raised by users and to compensate for the damage.

     The "Hyundai Department Store Internet Duty Free Shop" shall promptly handle complaints and opinions from users: Provided, That if it is difficult to process promptly, the user shall be notified of the reason and the schedule of processing immediately.

     If a user applies for damage relief in connection with an e-commerce dispute between the "Hyundai Department Store Internet Duty Free Shop" and the user, it may be subject to mediation by the Fair Trade Commission or a dispute mediation agency commissioned by the Mayor/Governor.

 

Article 25.  (Jurisdiction and governing law)

     A lawsuit concerning an e-commerce dispute between the "Hyundai Department Store Internet Duty Free Shop" and the user shall be governed by the address of the user at the time of the complaint, and if there is no address, it shall be under the exclusive jurisdiction of the district court having jurisdiction over the residence. If the address or residence of the user is not clear at the time of the complaint or a foreign resident, it shall be filed with the competent court under the Civil Procedure Act.

      The law of the Republic of Korea applies to dispute settlement, such as a lawsuit related to electronic transactions filed between the "Hyundai Department Store Internet Duty Free" and the user.

Article 1 (Effective Date)

This Agreement shall be effective as of 26, 2, 2024.

 

  • Collection of personal information

    HDDFS collects only the minimum amount of personal information required for the given task!

    • 1. What is “personal information”?
      “Personal information” refers to any information that identifies you. Examples include name, date of birth, phone number, and email address.
    • 2. What items of personal information does HDDFS collect?
      Upon membership registration, the applicant’s name, date of birth, passport number, gender, email address, and other items of information are collected to confirm his/her identity. For duty free purchases, the only information collected is that required by Korea’s Customs Act and necessary to undertake the purchase contract (e.g. passport number, departure information, payment details, etc.).
    • 3. Is personal information collected for HDDFS events?
      Personal information is collected for events hosted by HDDFS Online or for social media for customers who were informed of and consented to the items of personal information to be collected.
    • 4. How is personal information collected?
      Before personal information is collected, an announcement is made of the items of information for which consent will be received. Personal information is collected after the customer has expressed his/her consent by checking the “I consent” box or submitting his/her signature.
  • Use of personal information

    HDDFS uses personal information only for the purposes consented to by the customer!

    • 1. How is personal information used?
      The personal information of HDDFS members is used for customer management purposes (e.g. identity confirmation, customer consultation) and to enable the provision/management of services. For duty free purchases, personal information is used for identity confirmation and to maintain compliance with relevant laws.
    • 2. Are for-profit advertisements sent to registered members in the form of text messages or emails?
      For-profit advertisements are sent only to members who consented to receiving marketing-related information. HDDFS does not send for-profit advertisements without the customer’s consent. Even if the customer has consented, such information is sent according to a detailed set of guidelines (e.g. including the word “Advertisement” in the email’s title).
    • 3. Is personal information used indiscriminately?
      To ensure the protection of customers’ personal information, HDDFS has implemented a number of technical and supervisory measures, including: provision of employee training, conducting of regular self-administered audits, drawing up of in-house management plans, encryption of personal information, creation of hacking policy, restriction of access (offline and online), and storage of access records.
  • Disclosure of personal information

    HDDFS provides personal information to consigned third parties only after obtaining customers’ consent!

    • 1. When is personal information disclosed?
      To provide high-quality services to our customers, HDDFS consigns some tasks to third parties (business consignment). Personal information may also be disclosed to utilize the services of HDDFS' partners. Please note that personal information is consigned only after obtaining the consent of the customer!
    • 2. What does “business consignment” mean?
      For example, HDDFS consigns the tasks involved in customer consultation (responding to customers’ requests or inquiries) and product sales to external contractors. When consigning such tasks, HDDFS does its best to protect customers’ personal information through such means as regular checks of whether the contractor is abiding by relevant laws and training for the contractor’s employees.
    • 3. What does “disclosure to a third party” mean?
      For example, personal information may be disclosed to provide H.Point services, including point accrual and use. Of course, all disclosure is done only after obtaining the customer’s consent! If, however, such disclosure is for a purpose that is required by law, personal information may be disclosed to a third party without the customer’s consent.
  • Deletion of personal information

    HDDFS deletes customers’ personal information, when deemed necessary, promptly and in a secure manner!

    • 1. When is personal information deleted?
      HDDFS promptly deletes personal information when: 1) the customer withdraws his/her membership or 2) the retention period to which the customer consented regarding the storage and use of his/her personal information has ended. If, however, the customer has a purchase record, his/her personal information is stored separately for the period of time that is required by Korean law.
    • 2. What is a dormant member?
      If a customer does not log in to HDDFS’ website for a certain period of time (one year or three years), his/her personal information is stored separately. In this case, his/her personal information is not used at all!
    • 3. How is personal information deleted?
      Personal information that is saved on a computer in electronic format is deleted in such a manner that such information cannot be restored. Personal information in paper format is incinerated or shred very finely so that it is illegible.
  • Guarantee of rights

    HDDFS does its utmost to guarantee the rights of the customer regarding personal information!

    • 1. What does it mean to “guarantee the rights of the customer”?
      HDDFS does its best to adequately guarantee the customer’s rights. Whenever the customer requests the editing, deletion, or granting of permission to view one’s personal information, HDDFS complies with such request in a timely manner (after completing the relevant confirmation procedure).
    • 2. How can I edit my personal information or withdraw membership?
      Please refer to the following regarding the editing of personal information or withdrawal of membership via our website or mobile app!
      • Computer (website): Click the person-shaped icon (My Hyundai) at the upper right after logging in → Follow the downward arrow next to “Cash points/gift card cash points” at the lower right of the order details box → Click “Basic Information Management” at the lower left → Enter password → Edit personal information (or withdraw membership)
